33

وَلَا ٱلَّتِى إِلَّا وَمَن فَقَدْ فَلَا فِّى إِنَّهُۥ ﴿٣٣﴾

Translation

Saheeh International

And do not kill the soul which Allah has forbidden, except by right. And whoever is killed unjustly - We have given his heir authority, but let him not exceed limits in [the matter of] taking life. Indeed, he has been supported [by the law].

اسراف در قتل

جملةٌ اما در قتل اسراف نکند» به اعمالی که در زمان جاهلیت بود و امروز نیز گاهی صورت می‌گیردء اشاره دارد که گاهی احیاناً در برابر کشته شدن یک نفر از یک قبیله یا گروه یا خانواده» اولیای مقتول» خون‌های زیادی می‌ریختند. موضوع رعایت عدالت حتی در مورد قاتل در آن حد و پایه است که در وصایای امیرالموّمنین علی(ع) می‌خوانیم: «ای فرزندان عبدالمطلب, نبینم که به بهانةٌ کشته شدن منء در خون مسلمانان فرو افتید و بگویید که امیرالموژمنین کشته شد. بدانید که نباید به قصاص خون من جز قاتلم کشته شود. اگر من از این ضربت او کشته شدم, شما نیز یک ضربت به او بزنید. مبادا اعضای او را ببرید که من از رسول خدا(ص) شنیدم که فرمود: بپرهیز از مثله کردن؛ حتی اگر سگ هار باشد.»
